These conditions apply to all scheduled trips, meaning activities with fixed departure times as published on our website.
Confirmation
The order becomes binding when you receive a written booking-confirmation from Whale2Sea/Whalesafari. Please ensure you have received the confirmation via official email or message before considering your booking confirmed. Whale2Sea/Whalesafari is then responsible for delivering the products you have ordered, while you assume financial responsibility for the order for yourself and all participants in your group, as specified in the confirmation. By making a booking, you confirm that you have the authority to accept the terms on behalf of yourself and any travel companion. It is your responsibility to verify that all reservation details (names, dates, and times) are correct and that all participants are fully informed about the booking, meeting points, and any potential changes.
Cancellation policy
Bookings for 1 to 6 persons can be cancelled up to 24 hours prior to arrival free of charge for our products in Andenes. In Skjervøy up to 48 hours.
Bookings from 7-14 persons can be canceled up to 7 days before the scheduled departure free of charge.
Cancellations made after these deadlines will be charged your pre-payment, NOK 500.
Please note: the pre-payment is a fixed amount and will be retained in case of late cancellation.
Minimum number of participants
To ensure the operation of our tours and transport services, a minimum number of participants is required:
RIB Tours: minimum 6 participants
Large boat: minimum 24 participants
Other activities: 8 persons
If the minimum number of participants is not reached, we reserve the right to reschedule the trip or offer alternative solutions. You will be contacted in advance in such cases.
Complaints
Any complaints regarding the services provided by Whale2Sea/Whalesafari must be submitted in writing within 5 days after the trip. We recommend sending your complaint by email and keeping a copy for your records to avoid misunderstandings. Complaints submitted after this deadline will not be eligible for financial compensation.
Tour schedule adjustments
Tours may start earlier or later than usual due to sea conditions. We will notify your as soon as possible. (Guests must arrive 45 minutes before departure.) Guests must arrive at least 45 minutes before departure to ensure safety and allow proper boarding procedures.
Tour cancellations due to rough sea conditions
Safety is our highest priority. Cancellations are a decision made by our captain for safety reasons. If the captain decides to cancel a tour due to rough seas, you will receive a full refund of your pre-payment for our activities. We aim to provide cancellation notices at least 24 hours in advance, but unforeseen circumstances may require a later cancellation.
Description of execution
Whale2Sea/Whalesafari reserves the right to modify tours and programs due to weather conditions. All programs and tours may be changed or canceled for security reasons. If a tour is canceled on our part, the full amount paid will be refunded. The participant who made the booking will be contacted primarily via the email or telephone number provided during the booking. (Therefore, it is essential to check your email/messages regularly for updates). Please make sure to check your email and messages regularly for updates.
No whale sightings policy
If no whales are spotted during a tour, guests may join another whale-watching trip free of charge on the next available tour or later, any day or year. Guests must provide the booking number of the original tour when rebooking.
Responsibility
The organizer is covered for liability through its insurance agent. It is recommended that participants have personal travel insurance. (Participants must also have a valid travel insurance.) Whale2Sea/Whalesafari is not responsible for losses or additional costs due to delays beyond the company's control such as strikes, accidents, illness or other force majeure circumstances. Whale2Sea/Whalesafari is not responsible for personal belongings brought by the customer, such as bags, glasses, camera / phone, clothes, etc.
Customer responsibilities
The participants are responsible for determining whether they are physically and mentally fit to participate in booked tours. The customer must comply with the rules of order and instructions provided by the organizer.
Whale2Sea/Whalesafari reserves the right to deny participation in a tour if the customer is a threat to safety, either for himself or the other participants, or if the customer’s behavior causes significant disruption to fellow participants and crew.
By booking a tour, participants confirm that there are no medical concerns preventing their participation in the program. All instructions from staff must be followed. Failure to comply may result in the participant being removed from the tour, (with no right to a refund.) with no entitlement to a refund.
If a participant chooses to leave a tour or program early, they will not be entitled to a refund.
Disputes
Any disputes between customers and Whale2Sea/Whalesafari fall under the jurisdiction of the local courts where Whale2Sea/Whalesafari is located.
